These Terms & Conditions ("Terms") form a binding agreement between you ("you," "your," or "Athlete") and The Struggle Standard LLC ("we," "us," or "our"), an Idaho limited liability company. By purchasing, accessing, downloading, or using any program, content, service, or event we offer — including Earn The Right ("ETR"), Conjugate Hybrid Training ("CHT"), and The Struggle Standard Test ("the Test") — you agree to these Terms in full, together with our Privacy Policy, Refund Policy, Liability Waiver, and Medical Disclaimer, each incorporated by reference. If you do not agree, do not purchase or use our programs.
01Who We Are
The Struggle Standard LLC designs, writes, and delivers structured strength and conditioning programming under The Struggle Standard™ brand, including ETR, CHT, and the Test. We are your coach in the way that matters here: we author the prescriptions, progressions, and standards you train against, and we stand behind them. That coaching is delivered through pre-built, generalized programs and broadcast guidance written for a broad athletic audience — it is not individualized one-on-one personal training, and it is not medical advice, physical therapy, nutrition counseling, or supervision tailored to your specific health, injuries, or circumstances. Our programming does not replace in-person evaluation by a licensed professional, and you remain responsible for deciding whether and how to apply it to your own body.
02Eligibility
By using our programs you represent and warrant that:
- You are at least 18 years of age, or are using the program under direct adult supervision with parental or guardian consent.
- You have been medically cleared by a qualified physician to engage in vigorous resistance training and conditioning.
- You are not pregnant, recovering from surgery, managing a cardiovascular condition, or under any other restriction that would make heavy training unsafe — or, if you are, you have received explicit clearance from your physician to attempt the program you are purchasing.
- You have read, understood, and agreed to the Liability Waiver and Medical Disclaimer.
03The Programs
3.1 — Earn The Right (ETR)
ETR is a 16-wave on-ramp resistance and conditioning program built on an 8-day cycle, intended for athletes preparing to attempt CHT or driving body recomposition inside a structured architecture. It is delivered via TrainHeroic and supplementary PDF documents.
3.2 — Conjugate Hybrid Training (CHT)
CHT is a 12-wave, 53-week advanced periodized program built on a 9-day cycle, training six concurrent physical qualities and peaking at the Struggle Standard test cluster. CHT prescribes near-maximal and maximal loading and high-volume conditioning. It is not appropriate for beginners or for athletes who have not completed ETR or demonstrated equivalent training history.
3.3 — The Struggle Standard Test
The Test is an annual six-event physical performance assessment. Registration is $15 and includes the right to submit one scored attempt during the published testing window. Participation is voluntary, self-administered, and subject to the separate Annual Test Participation Waiver.
04License & Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the program(s) you have purchased for your own personal, non-commercial training. You may not:
- Share, resell, sublicense, distribute, post, or publicly display any program content, including PDFs, videos, TrainHeroic team content, exercise selections, prescriptions, or written instruction.
- Use any program content to train paying clients, coach athletes, or operate a competing fitness business.
- Reverse-engineer, scrape, or use any program content to train artificial intelligence or machine learning systems.
- Remove or alter any copyright, trademark, or attribution notices.
Violation of this section terminates your license immediately and may result in legal action and forfeiture of any fees paid.
05Intellectual Property & Trademarks
All program content — including written prescriptions, programming architecture, video, photography, branding, and all derivative materials — is owned by The Struggle Standard LLC and protected by U.S. and international copyright law. Purchase does not transfer ownership of any intellectual property.
The Struggle Standard™ and Suffer Forward™ are trademarks of The Struggle Standard LLC. "Earn The Right," "Conjugate Hybrid Training," and "The Struggle Standard Test" are marks used by The Struggle Standard LLC to identify its programs and services. You may not use any of these marks without our prior written permission.
06Purchases, Pricing & Payment
Purchases are processed through third-party platforms (currently TrainHeroic and our website payment processor). Prices are listed in U.S. dollars and may change without notice; the price in effect at the time of your purchase is the price you pay. You are responsible for all applicable taxes. By completing a purchase you authorize us and our payment processors to charge your payment method for the full amount disclosed at checkout.
07No Refunds
All sales are final. We do not offer refunds, returns, exchanges, or credits on any digital product, training program, or Test registration, except where required by applicable law. See our Refund Policy for full details.
08Program Delivery & Access
Programs sold through TrainHeroic are delivered as lifetime-access teams or self-paced programs unless otherwise specified at purchase. We do not guarantee uninterrupted access to any third-party platform, and access may be affected by changes to those platforms outside our control. PDFs and supplementary materials are delivered by digital download or email.

You agree to indemnify, defend, and hold harmless The Struggle Standard LLC, its owner, members, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of any program; (b) your breach of these Terms; (c) your violation of any third-party right; or (d) any injury, illness, or death you, or anyone training under your direction, sustains in connection with the programs.
12Dispute Resolution & Arbitration
Any dispute arising out of or related to these Terms or the programs shall first be addressed through good-faith negotiation. If unresolved within 30 days, the dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Kootenai County, Idaho. You and we each waive any right to a jury trial and to participate in any class action or representative proceeding. Either party may still seek injunctive relief in court to protect intellectual property rights.
13Governing Law & Venue
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws principles. Subject to the arbitration provision above, the exclusive venue for any permitted court action shall be the state or federal courts located in Kootenai County, Idaho.
14Changes to These Terms
We may update these Terms at any time. The effective date above reflects the most recent revision. Material changes will be communicated by email or platform notice where practical. Continued use of the programs after changes take effect constitutes acceptance.
15Severability & Entire Agreement
If any provision is held unenforceable, the remaining provisions remain in full force. These Terms, together with the documents incorporated by reference above, constitute the entire agreement between you and The Struggle Standard LLC regarding the programs.
